LexPath — Terms & Conditions

Effective date: 10 August 2025

Please read carefully. These Terms & Conditions (“Terms”) govern your access to and use of LexPath’s websites, apps, services and content (together, the “Platform”). By creating an account, using the Platform, posting or applying for jobs, or purchasing a paid membership, you accept these Terms.

LexPath Australia Pty Ltd (ABN: 75 689 261 541) (“LexPath”) is a business incorporated/operating in Australia. Our contact email is lexpath.au@outlook.com and postal address is 2 Capella Street, Coorparoo QLD 4151.

1. Employer vs Candidate — how the Platform works

Employers may create employer accounts, post jobs, purchase memberships, access applications, and contact candidates. Employers are responsible for the accuracy of job ads and for compliance with employment, anti-discrimination and industrial laws when hiring.
Candidates may create profiles, upload resumes, search jobs, apply, and use candidate features (including paid premium services, if offered). Candidates must not impersonate others or post false information. Candidates must also provide accurate information. You agree to keep your account information up to date and not to share login credentials.

2. Paid services, subscriptions and billing

Paid products (e.g. single job listings, multi-post packages, premium placements, or any other subscriptions/memberships) are described in the Pricing page on the Platform. A price, billing frequency, and any trial period will be shown before purchase. These prices may vary from time to time, and changes to the price will be made known on the Pricing page, or another payment page.
For subscriptions/memberships: subscriptions auto-renew unless you cancel. You are responsible for providing current payment details. By subscribing you authorise LexPath to charge the payment method you provide.
Tax: listed prices may include GST where applicable, receipts and payment gateways will show GST where required.
Cancellation & refunds: we will handle cancellations and refunds in accordance with these Terms and applicable Australian law. If you cancel a subscription/membership while it remains active, you may continue to use the paid features until the end of the paid period, unless expressly stated otherwise. For one-off ads, including top ups, we do not offer a refund and it is your responsibility to make use of your purchase. LexPath, at its sole discretion, may agree to refund you an amount, or part of an amount, for which you have paid for our Platform.

3. Trials, promotional pricing and free offers

Free trials or promotional pricing (if offered) are governed by the promotional terms at sign-up. We may require you to enter payment details to start a trial and will clearly show when the trial ends and the price that will be charged on auto-conversion. It is your responsibility to cancel before conversion to avoid charges. If and when your purchase converts to a paid service, the cancellation and refunds policy found in these Terms will apply.

4. Employer responsibilities and ad content rules

Employers must ensure job ads are accurate, lawful and not misleading. Employers are solely responsible for the accuracy, lawfulness, and content of their job ads and employer profiles. LexPath does not endorse or make any representation about any Employer, job ad, or employer profile, and is not responsible for any inaccuracies, omissions, or unlawful material in such content. Nothing in this clause limits or excludes any rights or remedies a Candidate may have under the Australian Consumer Law.
Prohibited content includes but is not limited to: scams, pay-to-apply schemes that exploit candidates, ads requiring payment to apply (unless clearly stated and lawful), illegal roles, pornographic or hateful content, and content that violates third-party rights.

5. Candidate responsibilities

Candidates must provide truthful information and may not apply using false identities or fake documents. Candidates are responsible for the truthfulness of applications and for any supporting documents.
Candidates consent to allow Employers and LexPath to contact them about roles and to share their publicly visible profile information with employers and approved third parties where the Platform provides such functionality (see Privacy Policy for more detail).

6. Consumer guarantees, warranties & disclaimers

Your rights under Australian Consumer Law (ACL): If you are a consumer, you have rights under the ACL (including guarantees about services being provided with due care and skill, being fit for purpose, and delivered within a reasonable time). These rights cannot be excluded. LexPath’s liability for failure of these guarantees is set out in the ACL.
Our warranties: We provide the Platform “as is” and make commercially reasonable efforts to keep it available and accurate, but we do not guarantee continuous, error-free, or virus-free access. To the maximum extent permitted by law, LexPath disclaims all warranties except those that cannot be lawfully excluded.
Limits on liability: Subject to any rights that are not to excludable by law, LexPath’s aggregate liability for any claim arising from these Terms is limited to the amount paid by you to LexPath in the prior 12 months (or AUD $100 if you paid nothing). This limit may be varied depending on your contract with us and applicable law.

7. Privacy, data handling and security

Our Privacy Policy explains how we collect, use, disclose and store personal information. We aim to handle personal information in line with the Australian Privacy Principles. For instance, we try to only collect what is necessary to operate the Platform (profile details, resume/CV, application history, employer contact details), we may store data on third-party cloud providers, and we will take reasonable steps to protect personal information. You have rights to access and correct your information at any time. If a request is made, we will make all reasonable endeavors to action it as soon as possible.
Where we transfer data offshore (e.g., cloud hosting outside Australia), we will disclose this in the Privacy Policy and take reasonable steps to ensure comparable protection to that required in Australia. If you have data-locality concerns please contact us at lexpath.au@outlook.com.
Candidates, for your own privacy, we expect that you do not upload sensitive health or highly personal information unless it is explicitly requested. Be advised that LexPath will not request sensitive information from you, but we may redirect you to an Employer’s job application portal. Upon request, you may wish to provide that Employer with sensitive health or personal information. If you do so, LexPath does not bear any liability with how that information is protected or otherwise managed by the Employer.
Employers, we expect that you will only request and store candidate data that is lawful and relevant to recruitment. Do not misuse candidate data.

8. Communications, marketing & spam compliance

By creating an account you may receive service messages and marketing messages. We will only send commercial electronic messages with your consent or as otherwise permitted by law, and every commercial message will contain a functional unsubscribe option in compliance with the Spam Act 2003. Employers and Candidates must not use the Platform to send unauthorised marketing messages to one another.

9. Intellectual property

LexPath owns (or is licensed to use) the Platform’s content, branding, code and designs. You are granted a limited, non-exclusive licence to use the Platform as permitted.
You retain ownership of the content you upload (e.g., your CV), but by posting you grant LexPath a worldwide, royalty-free licence to use, host, copy, distribute and display that content to operate the service (this includes sharing with Employers’). If you want content removed, follow our content removal process; we will comply subject to legal and operational constraints.
If you believe your IP has been used incorrectly, contact lexpath.au@outlook.com and follow our infringement procedure.

10. Background checks, references and hiring decisions

LexPath is a platform connecting employers and candidates. We do not make hiring decisions. Employers are responsible for conducting appropriate checks (e.g., references, police checks, working rights) where lawful and relevant. Candidates are responsible for the accuracy of any claims about qualifications or experience. LexPath may offer third-party background checking services — use of those services is subject to separate terms.

11. Prohibited uses and sanctions

You must not use the Platform for fraud, unlawful discrimination, defamation, harassment, unauthorised data scraping, automated bulk extraction, or for selling illegal goods or services. We may suspend or terminate accounts that breach these rules.
We may also restrict or remove content and cooperate with law enforcement.

12. Termination & suspension

We may suspend or terminate accounts for breach of these Terms, or conduct we otherwise deem to be abuse, safety, harassment, discrimination, fraud or a similar concern. You may close your account at any time via your account settings; closing your account does not automatically cancel outstanding paid obligations — refer to the billing/cancellation steps in Section 4. Any outstanding fees will remain payable.

13. Changes to these Terms

We may update these Terms. Material changes will be notified by email or a prominent notice on the Platform within 14 days of the changes taking effect, if reasonably practicable. Continued use of the Platform after a change means you accept the new Terms.

14. Dispute resolution & governing law

These Terms are governed by the laws of Queensland, Australia. If you have a dispute with our service, please contact us at lexpath.au@outlook.com and we will try to resolve it. If unresolved, disputes may be referred to mediation or to a court with jurisdiction.
For small claims or consumer disputes, you may also contact relevant regulators such as the ACCC, OAIC (privacy issues) or ACMA (spam issues).

15. Electronic contracts and signatures

You agree that contracts, notices and consents can be provided electronically and electronic signatures and records are valid to the extent permitted by law (Electronic Transactions Act).

16. Third-party services and links

The Platform may link to third-party services (payment providers, background checkers, analytics). Those services have their own terms and privacy practices. We are not responsible for third-party acts or omissions. Employers and Candidates using third-party integrations are bound by those third-party terms.

18. Miscellaneous

If a court finds any part of these Terms invalid, the rest remains in effect. These Terms are the entire agreement between you and LexPath regarding this Platform, unless we have a separate written agreement.
